1) Scope

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") of Wahid Rahimi, acting under "Rahimi Beauty" (hereinafter referred to as "Seller"), apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter referred to as "Customer") concludes with the Seller regarding the goods displayed by the Seller in his online shop. The inclusion of the Customer's own conditions is hereby rejected, unless otherwise agreed.

1.2 These GTC also apply to contracts for the delivery of vouchers, unless expressly stated otherwise.

1.3 These GTC also apply to contracts for the delivery of tickets, unless expressly stated otherwise. These GTC only govern the sale of tickets for certain events specified in the Seller's product description, and not the organization or execution of these events. For the execution of the events, only the legal provisions between the Customer and the organizer, and any terms of the organizer, apply. If the Seller is not also the organizer, he is not liable for the proper execution of the event, for which the respective organizer is solely responsible.

1.4 A consumer within the meaning of these GTC is any natural person who concludes a legal transaction for purposes that are predominantly not attributable to their commercial or independent professional activity. An entrepreneur within the meaning of these GTC is a natural or legal person or a partnership with legal capacity that acts in the course of their commercial or independent professional activity when concluding a legal transaction.

2) Conclusion of Contract

2.1 The product descriptions contained in the Seller's online shop do not constitute binding offers from the Seller, but serve as an invitation for the Customer to make a binding offer.

2.2 The Customer can submit the offer via the online order form integrated into the Seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic order process, the Customer submits a legally binding offer concerning the goods in the shopping cart by clicking the button that completes the order process.

2.3 The Seller may accept the Customer's offer within five days by:

  • Sending a written order confirmation or an order confirmation in text form (fax or email) to the Customer, with the receipt of the order confirmation by the Customer being decisive, or
  • Delivering the ordered goods to the Customer, with the receipt of the goods by the Customer being decisive, or
  • Requesting payment from the Customer after the order has been placed.

If several of the above-mentioned alternatives apply, the contract is concluded at the point when one of these alternatives occurs first. The period for accepting the offer begins the day after the Customer sends the offer and ends at the end of the fifth day following the submission of the offer. If the Seller does not accept the Customer's offer within the specified period, this is considered a rejection of the offer, meaning the Customer is no longer bound by their declaration of intent.

2.4 If a payment method offered by PayPal is selected, the payment processing is handled by the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter: "PayPal"), under the applicable PayPal terms of use, available at https://www.paypal.com/de/webapps/mpp/ua/useragreement-full or – if the customer does not have a PayPal account – under the terms for payments without a PayPal account, available at https://www.paypal.com/de/webapps/mpp/ua/privacywax-full. If the customer makes a payment using one of PayPal's offered payment methods selected during the online order process, the Seller hereby accepts the customer's offer at the moment the customer clicks the button that completes the order process.

2.5 When submitting an offer via the Seller's online order form, the contract text is stored by the Seller after the contract is concluded and sent to the customer in text form (e.g., email, fax, or letter) after the customer's order has been submitted. The Seller does not provide further access to the contract text. If the customer has set up a user account in the Seller's online shop before submitting the order, the order data is archived on the Seller's website and can be retrieved by the customer free of charge through their password-protected user account by entering the relevant login details.

2.6 Before submitting the order bindingly via the Seller's online order form, the customer can identify any input errors by carefully reading the information displayed on the screen. A useful technical tool for better identifying input errors may be the browser's zoom function, which allows enlarging the display on the screen. The customer can correct their entries during the electronic order process as long as they use the standard keyboard and mouse functions, until they click the button that completes the order process.

2.7 The contract can only be concluded in the German language.

2.8 Order processing and communication usually take place via email and automated order processing. The customer must ensure that the email address provided for order processing is correct, so that emails sent by the seller can be received at this address. In particular, the customer must ensure that all emails sent by the Seller or by third parties commissioned by the Seller for order processing can be delivered when using spam filters.

3) Right of Withdrawal

3.1 Consumers generally have a right of withdrawal.

3.2 Further information regarding the right of withdrawal can be found in the Seller's withdrawal instruction.

3.3 According to § 312g para. 2 no. 9 BGB, the right of withdrawal does not apply, unless otherwise agreed, to contracts for the provision of services related to leisure activities, if the contract specifies a specific date or period for the provision. The right of withdrawal is also excluded for contracts involving the sale of tickets for time-bound leisure events.

4) Prices and Payment Terms

4.1 Unless otherwise stated in the product description of the Seller, the prices indicated are total prices that include the statutory VAT. Any additional delivery and shipping costs that may apply are specified separately in the respective product description.

4.2 The available payment options will be communicated to the customer in the Seller's online shop.

4.3 If advance payment by bank transfer is agreed, payment is due immediately after the contract is concluded, unless the parties have agreed on a later due date.

4.4 If the payment method "PayPal Direct Debit" is selected, PayPal will debit the invoice amount from the customer's bank account after the SEPA direct debit mandate is granted, but not before the pre-notification period has expired, on behalf of the Seller. A pre-notification ("Pre-Notification") is any communication (e.g., invoice, policy, contract) to the customer announcing a charge via SEPA direct debit. If the direct debit is not honored due to insufficient funds or due to the provision of incorrect bank account details, or if the customer disputes the charge although they are not entitled to do so, the customer will bear the fees incurred by the respective bank for the reversal of the transaction if the customer is responsible for this.

5) Delivery and Shipping Conditions

5.1 Goods are delivered via shipping to the address provided by the customer, unless otherwise agreed. The delivery address provided during the order processing by the Seller is authoritative.

5.2 If delivery of the goods fails due to reasons for which the customer is responsible, the customer will bear the reasonable costs incurred by the Seller as a result. This does not apply to shipping costs regarding the return if the customer exercises their right of withdrawal effectively. For return costs, the regulations in the Seller's withdrawal instructions apply when the right of withdrawal is exercised effectively by the customer.

5.3 Self-collection is not possible due to logistical reasons.

5.4 Vouchers are provided to the customer as follows:

6) Retention of Title

If the Seller makes an advance payment, they retain ownership of the delivered goods until the full payment of the agreed purchase price has been made.

7) Warranty (Defects Liability)

7.1 If the purchased item is defective, the provisions of the statutory warranty apply.

7.2 If the customer acts as a consumer, they are requested to report any obvious transport damages to the delivery service and inform the Seller. If the customer does not comply, this will not affect their legal or contractual warranty claims.

8) Redemption of Promotional Vouchers

8.1 Vouchers issued by the Seller as part of promotions with a specific validity period and provided free of charge (hereinafter referred to as "promotional vouchers") can only be redeemed in the Seller's online shop and only within the specified period.

8.2 Certain products may be excluded from the voucher promotion if such a restriction is specified in the content of the promotional voucher.

8.3 Promotional vouchers can only be redeemed before completing the order process. Retroactive redemption is not possible.

8.4 Only one promotional voucher can be redeemed per order.

8.5 The value of the goods must be at least equal to the value of the promotional voucher. Any remaining credit will not be refunded by the Seller.

8.6 If the value of the promotional voucher is not enough to cover the order, the remaining balance can be paid using one of the other payment options offered by the Seller.

8.7 The credit of a promotional voucher will not be paid out in cash or accrue interest.

8.8 The promotional voucher will not be refunded if the customer returns the goods paid for entirely or partially with the promotional voucher under their statutory right of withdrawal.

8.9 The promotional voucher is intended for use only by the person named on it. Transfer of the promotional voucher to third parties is excluded. The Seller is entitled, but not obligated, to verify the material entitlement of the respective voucher holder.

9) Redemption of Gift Vouchers

9.1 Vouchers that can be purchased through the Seller's online shop (hereinafter referred to as "gift vouchers") can only be redeemed in the Seller's online shop unless the voucher specifies otherwise.

9.2 Gift vouchers and the remaining balance of gift vouchers can be redeemed until the end of the third year after the year of purchase. Any remaining balance will be credited to the customer until the expiration date.

9.3 Gift vouchers can only be redeemed before completing the order process. Retroactive redemption is not possible.

9.4 Multiple gift vouchers can be redeemed in a single order.

9.5 Gift vouchers can only be used for the purchase of goods and not for the purchase of additional gift vouchers.

9.6 If the value of the gift voucher is not sufficient to cover the order, the remaining balance can be paid using one of the other payment methods offered by the Seller.

9.7 The balance of a gift voucher will not be paid out in cash or accrue interest.

9.8 The gift voucher is intended for use only by the person named on it. Transfer of the gift voucher to third parties is excluded. The Seller is entitled, but not obligated, to verify the material entitlement of the respective voucher holder.

10) Applicable Law

All legal relationships between the parties are governed by the law of the Federal Republic of Germany, excluding the laws on international sales of movable goods. This choice of law applies to consumers only insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.

11) Alternative Dispute Resolution

11.1 The EU Commission provides a platform for online dispute resolution at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a point of contact for the out-of-court settlement of disputes arising from online purchase or service contracts involving a consumer.

11.2 The Seller is neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration body.
